(“AllTrack”, “we”, “us” or “our”) is a United States based music rights management organization that represents the rights of songwriters, composers, lyricists, producers and publishers, and grants licenses for the use of the associated musical works in its repertory. AllTrack is proud to play a leading role in supporting the long-term success of its many affiliates and the music industry as a whole and in supporting the music using business community to achieve proper compliance with copyright law.

AllTrack knows that you care about your personal information and how it is used and shared. An important part of AllTrack’s commitment to its affiliates, licensees, employees, and visitors (“you” or “your”) is respect for your right to privacy. WHAT PERSONAL INFORMATION WE COLLECT AND WHY WE COLLECT IT

AllTrack is committed to only collecting personal information that assists it with properly conducting its business and only collecting it by fair and lawful means. The information that we gather enables us to:

  • to establish accounts;
  • to provide you service and customer support;
  • to enable you to participate in a variety of the Website’s features;
  • to improve the Website, marketing endeavors or our Website offerings;

  • remember your information so that in certain cases you will not have to re-enter it during your visit or the next time you visit the Website;

Information provided by you

Most personal information collected by AllTrack is voluntarily supplied by you when you sign up, request, and/or utilize any of the services that we provide to our affiliates, licensees, and/or visitors, or when you engage in communications with AllTrack and/or become an employee or consultant of AllTrack. For these reasons, AllTrack collects different types of information from different types of interactions and/or parties. Please note that you may fall under more than one type of party with whom AllTrack interacts.

The following personal information may be collected and used by AllTrack to communicate with you, for security reasons, quality assurance, quality improvement, and to fulfill AllTrack’s legal and legitimate business requirements:

  • Web Beacons. Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) may be included in our Website’s pages and messages. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash and/or HTML5 cookies.
  • Recognition Technologies. Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user).

The following personal information may be collected and used by AllTrack to communicate with you, to comply with tax laws and regulations, for security reasons, quality assurance, quality improvement, to fulfill AllTrack’s legal and legitimate business requirements, to ensure you are properly identified as an employee of AllTrack, to administer payroll and employee benefit programs, and to be able to contact your emergency contact in case we need to notify anyone of your involvement in an emergency situation while at work:

Personal information provided by third parties

Some personal information collected by AllTrack is provided by third parties, including foreign collection societies with whom AllTrack has entered agreements with. Foreign societies provide us with information related to their works and information regarding usage of AllTrack’s repertory outside of the United States. AllTrack may also collect personal information from external databases that it has access to.

Personal information about other individuals

If you provide us with information about other individuals (e.g. your next of kin), you confirm that you have informed the relevant individuals accordingly.

Public information

AllTrack may maintain a public repertory on its Website that contains information about musical works in AllTrack’s repertory and any foreign repertory that AllTrack is authorized to license. This information may include personal information of AllTrack affiliates and/or members of international collecting societies affiliated with AllTrack, including names, work identification numbers, affiliated societies and IPI numbers.

California “do not track” disclosures

Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or online services (e.g. browser do not track signals). Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

DISCLOSURE OF YOUR PERSONAL INFORMATION

AllTrack is committed to a high standard of confidentiality and privacy. AllTrack will only use and/or disclose your personal information for the reason(s) it was collected. This means that AllTrack will share your personal information with you for the purpose of providing or improving our services, and may share specific personal information with third parties engaged to:

  • assist us in designing, providing or improving our services, operations or technology
  • process work usage and other data
  • provide cloud computing services
  • facilitate exchange of information relating to the works in which rightsholders own or control and for the purposes of licensing, collection and distribution of royalties
  • facilitate exchange of information relating to benefits or offers provided to or to be made available to our affiliated writers and publishers

  • provide customer service
  • other services designed to assist us in maximizing our business potential

These third parties are prohibited from using your personal information for any purpose other than to provide the services noted above, and they are required to protect all personal information and comply with the general privacy principles described in this Privacy Policy.

We may access, use, preserve, transfer and disclose your information to third parties: (i) to satisfy any applicable law, rule, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Website’s Terms of Use, Terms of Service, or other policies applicable to the Website, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Website or any third party; (iv) to detect, prevent or otherwise address fraud, security or technical issues; and/or (v) in connection with credit risk reduction efforts. If AllTrack, or all or any portion of its business or assets, are acquired, sold, or otherwise transferred, including in any merger or other transaction, or in the unlikely event that AllTrack goes out of business or enters bankruptcy, we reserve the right to disclose and transfer information: (i) to a subsequent owner, co-owner or operator of the Website or applicable database; (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process; or (iii) in connection with a bankruptcy or insolvency proceeding.

However, you should be aware that if you withdraw your consent, AllTrack may be unable to fulfill certain services such as paying you your royalties or granting you a license, which could render you in violation of IP law if you play music from AllTrack’s repertory.

ADS AND INFORMATION ABOUT YOU

Data about your activities online is being collected on our Website for use in providing advertising tailored to your individual interests. We may use third parties such as network advertisers and ad exchanges to serve advertisements across the Internet and may use third party analytics service providers to evaluate and provide us and/or third parties with information about the use of these ads on third party websites and viewing of ads and of our content. Your AllTrack account Information is protected by a password for your privacy and security. You need to protect unauthorized access to your account and information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account. You are prohibited from sharing your exclusive AllTrack login information and if you share your password or your information with others, remember that you are responsible for all actions taken in the name of your account. If you lost control of your password, you may lose substantial control over your information and may be subject to legally binding actions taken on your behalf. HOW YOU CAN ACCESS AND CONTROL YOUR PERSONAL INFORMATION

In the course of interacting with AllTrack, you are welcome to review or verify your personal information. In most cases AllTrack collects your personal information directly from you. If you discover inaccuracies in AllTrack’s data, please make the appropriate changes within your account settings or notify AllTrack to make the necessary changes. AllTrack may need specific information from you for identify confirmation or for other purposes, to enable AllTrack to search for and provide you with the personal information AllTrack holds about you. This Privacy Policy only governs information collected on the Website. These third parties may have their own terms of service, privacy policies or other policies and ask you to agree to the same. For example, if you “click” on a link, the “click” may take you off the Website onto a different location. We are not responsible for these third-party privacy policies or the practices of third-party parties. CHILDREN

Children Under 13 Years of Age

Consistent with the federal Children's United States Online Privacy Protection Act of 1998 ("COPPA"), we will never knowingly collect personally identifiable information from anyone under the age of 13 without requiring parental consent. Any person who provides their personal information to AllTrack through the Website represents that they are 13 years of age or older. California Minors under 18 Years of Age

California law provides additional rights to minors under the age of 18 residing in California. You may request the removal of any of your information you submitted while under the age of 18. Note that AllTrack can and will remove information of individuals meeting this criteria upon request from its internal systems but cannot guarantee removal of information that you requested be provided to any systems outside of AllTrack’s control.

European Union and European Economic Area

The Website is not intended for children accessing the Website from the European Union or the European Economic Area who are under the age of 16.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to change this Privacy Policy at any time without notice to you. Any changes will be effective immediately upon the posting of the revised Privacy Policy and your use of our Website indicates your consent to the Privacy Policy posted at the time of use. However, we will not use your previously collected personal information in a manner materially different than indicated at the time it was collected without your consent.
